Terms of Service

These Terms of Service (“Terms”) constitute a contract between you (“Customer”) and Timothée GAUCHEZ, auto-entrepreneur registered under SIRET 10223790600015, operating under the trade name FastQ (“FastQ”, “we”, “us”), for the purchase and use of FastQ software licenses.

By completing a purchase on fastq.oxoghost.dev you agree to these Terms in full. If you do not agree, do not purchase a license.

1. Eligibility

You must be at least 18 years old and legally capable of entering into contracts under French law to purchase a license. If you purchase on behalf of a legal entity, you represent that you have authority to bind that entity.

2. What You Are Buying

You are purchasing a license to use the FastQ software — not the software itself. The software remains the intellectual property of Timothée GAUCHEZ at all times. The scope of the license granted is defined in the End User License Agreement.

3. Payment and Subscription

Payments are processed by Stripe, Inc. FastQ never handles or stores your payment card details.

Pro and Enterprise subscriptions are recurring. Your subscription renews automatically at the end of each billing period (monthly or annually) at the then-current price. You will receive an email receipt from Stripe for each renewal.

We reserve the right to change prices with 30 days’ written notice by email. If you do not cancel before the price change takes effect, you accept the new price.

4. Cancellation

You may cancel your subscription at any time by emailing support@fastq.oxoghost.dev. Cancellations are processed within 2 business days.

Upon cancellation:

• You will not be charged for the next billing period.
• Your license key(s) will remain active until the end of the current paid period.
• After the paid period ends, all associated license keys will be revoked (set to status=revoked) and Pro features will cease to function.

There is no partial refund for unused days within a billing period, except as required by the EU 14-day withdrawal right (see Refund Policy).

5. License Transfer and Machine Change

A Pro or Enterprise license key is bound to a single machine at activation. To transfer a key to a new machine (e.g. after hardware replacement), contact support@fastq.oxoghost.dev with your order email and we will re-issue the key. Key transfers are limited to 2 per 12-month period for Pro licenses.

6. Acceptable Use

You may not:

• Share, sell, sublicense, or transfer license keys to third parties.
• Use a single key on more than one machine simultaneously.
• Circumvent, disable, or tamper with license verification mechanisms.
• Use the Free tier for commercial purposes (prohibited by the PolyForm Noncommercial license).
• Reverse-engineer, decompile, or disassemble Pro or Enterprise features.

Violation of these terms will result in immediate revocation of all your license keys without refund.

7. Availability and Updates

We will use reasonable endeavours to maintain the FastQ service and API. We do not guarantee 100% uptime for the license activation/verification server.

Software updates are provided as long as your subscription is active. We do not guarantee backwards compatibility between major versions.

8. Limitation of Liability

To the maximum extent permitted by French law:

• FastQ is provided “as is” without warranty of any kind, express or implied.
• We are not liable for any indirect, incidental, consequential, or punitive damages arising from your use of FastQ.
• Our total liability to you for any claim under these Terms shall not exceed the amount you paid for your subscription in the 3 months preceding the claim.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under French law.

9. Intellectual Property

FastQ, its source code, binary, documentation, and all associated assets are the exclusive property of Timothée GAUCHEZ and are protected by French intellectual property law (Code de la Propriété Intellectuelle).

The Free tier source code is made available under the PolyForm Noncommercial License 1.0.0. Pro and Enterprise features are proprietary and closed-source.

10. Termination

We may terminate or suspend your license immediately, without prior notice, if you breach these Terms. Upon termination, your license keys will be revoked and you must cease all use of Pro/Enterprise features.

11. Governing Law and Jurisdiction

These Terms are governed by French law. Any dispute arising from or in connection with these Terms that cannot be resolved amicably shall be subject to the exclusive jurisdiction of the courts of Versailles, France (tribunal compétent du ressort du siège social).

If you are a consumer resident in the EU, you also have the right to use the EU Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email at least 14 days before they take effect. Continued use of a paid subscription after the effective date constitutes acceptance of the revised Terms.
